9. Introducing or sharing Creative Content in the Creator Hub does not deprive the Creator of the right to use their own Creative Content.
Article 6 (Characters Appearing in Creative Content)
1. Creators may use Neco to depict characters needed for their Works or Lore. In such cases, Creators may use Neco as characters with particular occupations, roles, or other characteristics by adding or changing clothing, equipment, tools, items, or other similar elements without altering the character design of Neco itself.
2. The Neco that may be used under the preceding paragraph are limited to characters in the Neco series listed in the Character Encyclopedia published by Nekowemon Official.
3. When creating a MOB, Creators must use a Neco specified in the preceding paragraph.
4. A MOB is created by adding or changing clothing, equipment, tools, items, or other similar elements of Neco. Even when such elements are added or changed, the copyright relating to the Neco remains with Nekowemon Official. A MOB is not treated as a new, independent Nekowemon character.
5. Creators may use characters listed in the Character Encyclopedia published by Nekowemon Official as characters appearing in their Works or Lore.
6. Except for Neco as provided in Paragraphs 1 and 2, Creators may not add or change the clothing, equipment, tools, items, or other design elements of characters listed in the Character Encyclopedia.
7. If a Creator wishes to create a new, independent Nekowemon character beyond the scope provided in Paragraph 1 and use that character in creative activities within the Creator Hub, the character must be registered as a Creator Character in accordance with Article 21.
8. Creators may not introduce new original cat characters that are not based on Nekowemon’s Unified Cat-face Design Identity as residents or characters within the Nekowemon Universe.
9. Creators may not use, as residents or characters within the Nekowemon Universe, characters they have created outside the Creator Hub or characters created by third parties for which Nekowemon Official does not hold the rights. However, this restriction does not apply to characters whose use has been approved by Nekowemon Official.
Article 7 (Copyright in Creative Content)
1. Copyright and other rights relating to Nekowemon characters, designs, names, logos, and other Nekowemon IP previously owned by Nekowemon Official belong to Nekowemon Official or the respective legitimate rights holders.
2. Copyright in expressions newly created by a Creator as part of Creative Content created by that Creator belongs to the Creator, unless otherwise provided in these Terms of Use or a separate agreement.
3. Merely introducing and sharing Creative Content in the Creator Hub does not transfer copyright in that Creative Content to Nekowemon Official or any other Creator.
4. By introducing and sharing Creative Content in the Creator Hub, the Creator grants Nekowemon Official permission to use such Creative Content for the operation of the Creator Hub; the introduction, publicity, and promotion of Nekowemon IP and creative activities; merchandising; corporate projects; and other business activities relating to Nekowemon.
5. The use provided for in the preceding paragraph includes reproduction, public transmission, publication, display, translation, adaptation, editing, modification, format conversion, and any other use of Creative Content necessary for the purposes specified in the preceding paragraph.
6. Nekowemon Official may permit companies, production companies, distributors, distribution service providers, and other third parties to use Creative Content to the extent necessary for the purposes specified in Paragraph 4.
7. The permissions granted under Paragraphs 4 through 6 will continue to apply even if the Creator withdraws from the Creator Hub, is automatically withdrawn, or becomes unreachable. The Creator may not request that any use already permitted under these Terms of Use be discontinued solely on any of these grounds, unless otherwise provided by applicable law or these Terms of Use.
8. By introducing and sharing Creative Content in the Creator Hub, the Creator grants other Creators permission to engage in Derivative Creation based on that Creative Content in accordance with these Terms of Use. The specific conditions applicable to Derivative Creation are set out in Articles 8 through 10.
9. Creators agree not to exercise their moral rights with respect to resizing, cropping, translation, editing, format conversion, or other modifications to Creative Content to the extent necessary for uses permitted under these Terms of Use. However, this does not permit Creative Content to be used in a manner that unjustly harms the honor or reputation of the Creator.
10. The ordinary introduction, publicity, and promotion of Creative Content by Nekowemon Official are governed by Article 14. Use for merchandising, corporate projects, and other business activities is governed by Articles 19 and 25 and other applicable provisions of these Terms of Use.
Article 8 (Derivative Creation in the Creator Hub)
1. As a general rule, Creative Content introduced and shared in the Creator Hub may be used for Derivative Creation by other Creators participating in the Creator Hub.
2. As a general rule, a Creator engaging in Derivative Creation under the preceding paragraph is not required to obtain individual permission from the Creator of the source Creative Content.
3. Even if Creative Content is inspired or influenced by Creative Content created by another Creator, it does not constitute Derivative Creation if it does not carry forward the creative elements of that Creative Content and is created as an independent story, setting, or other creative content.
4. A Creator engaging in Derivative Creation must notify the Creator who created the Creative Content that directly served as the source of the Derivative Creation, using the method specified in the Creator Hub User Guide or otherwise specified by Nekowemon Official. If there are multiple pieces of Creative Content that directly served as sources, each respective Creator must be notified.
5. The notification provided for in the preceding paragraph does not constitute a request for permission or approval of the Derivative Creation.
6. When introducing and sharing Derivative Creative Content in the Creator Hub, the Creator engaging in the Derivative Creation must display the name of the Creator and the title of the Creative Content for each of the following and provide a link through which the relevant Creative Content can be viewed:
(1) The Creative Content from which the Derivative Creation originated;
(2) The Creative Content that directly served as the source of the Derivative Creation.
7. If there are multiple pieces of Creative Content falling under Item (1) or Item (2) of the preceding paragraph, the information specified in that paragraph must be displayed for each such piece of Creative Content. If the same Creative Content falls under both Item (1) and Item (2), the information does not need to be displayed twice.
8. Displaying credit in connection with Derivative Creation does not mean that the original Creator has approved, supervised, jointly created, or endorsed the Derivative Creation.
Article 9 (Interpretation in Derivative Creation)
1. A Creator engaging in Derivative Creation may create new Creative Content based on their own creative interpretation while respecting the expression of the source Creative Content.
2. The mere use of the same character does not constitute Derivative Creation. The same applies when using a MOB or a Creator Character created by another Creator. Whether Creative Content constitutes Derivative Creation is determined not by its subject matter, genre, or other outward characteristics, but by whether it carries forward a story, original setting, or other creative elements from Creative Content created by another Creator.
3. The use of part of another Creator’s Creative Content, or the incorporation of events, original settings, or other creative elements from that Creative Content into one’s own Creative Content, may also constitute Derivative Creation.
4. The Creator of the source Creative Content may not request the removal, suspension of publication, or other action against Derivative Creative Content solely because its world, settings, story, or interpretation differs from what that Creator intended.
5. Notwithstanding the preceding paragraph, if Derivative Creative Content violates these Terms of Use, the rules of the Creator Hub, applicable law, or the rights of any third party, Nekowemon Official or the respective legitimate rights holder may take necessary action.
Article 10 (Copyright in Derivative Creation)
1. As a general rule, copyright in expressions newly created by a Creator through Derivative Creation belongs to the Creator who engaged in that Derivative Creation.
2. Engaging in Derivative Creation does not transfer to the Creator engaging in the Derivative Creation any copyright or other rights relating to the source Creative Content.
3. Even when Derivative Creation carries forward multiple pieces of Creative Content, copyright in the expressions newly created by each Creator belongs to the respective Creator.
4. Even where copyright belongs to each Creator in accordance with the preceding paragraphs, this does not prevent other Creators from engaging in Derivative Creation in accordance with these Terms of Use.
Article 11 (Collaborative Creation)
1. Multiple Creators may jointly create a single piece of Creative Content.
2. Creators participating in Collaborative Creation must mutually confirm the content of the Creative Content to be created, their respective roles, credits, and other necessary matters.
3. When Creative Content created through Collaborative Creation is made publicly available through an external service, the Public Creator Name of each participating Creator must be displayed so that the Creators who participated in the Collaborative Creation can be identified.
4. The fact that Creative Content was created through Collaborative Creation does not necessarily mean that all participants are joint authors of that Creative Content.
5. Copyright and other rights relating to Collaborative Creation will be handled in accordance with each Creator’s actual creative contribution and applicable law.
Article 12 (External Publication of Creative Content)
1. Creators may make Creative Content they have created publicly available through social media, video-sharing platforms, blogs, game publishing platforms, and other external services.
2. When Creative Content created through Derivative Creation is made publicly available through an external service, the Public Creator Name of the Creator who created that Creative Content must be displayed.
3. In the case described in the preceding paragraph, Creators are not required to display on the external service any credit or link identifying the source Creative Content, the Creator who created the source Creative Content, or any other information indicating the derivative relationship.
4. Credits for source Creative Content in Derivative Creation must be displayed within the Creator Hub in accordance with Article 8 and the Creator Hub User Guide.
5. When sharing or introducing a Work created by another Creator, Creators may not, without permission, sell or merchandise that Work, license it to a third party, or distribute it in a form that allows third parties to reuse it.
6. If a Creator adds new creative expression to Creative Content created by another Creator beyond the scope of sharing or introducing it, Articles 8 through 10 will apply as Derivative Creation.
Article 13 (Monetization in the Creator Hub)
1. Creators may monetize Creative Content introduced and shared in the Creator Hub, as well as Derivative Creative Content, to the extent permitted under the Creator Program Terms of Use, the terms and conditions applicable to the Creator License, and any other applicable terms.
2. Unless otherwise separately agreed, monetization under the preceding paragraph does not require the Creator to distribute compensation, royalties, revenue, or other proceeds to the Creator of the source Creative Content or to any other Creator included in the creative lineage.
3. Creators may not monetize Creative Content through any method that is not permitted under the Creator Program Terms of Use, the terms and conditions applicable to the Creator License, or any other applicable terms.
Article 14 (Use of Creative Content by Nekowemon Official)
1. Nekowemon Official may use Creative Content free of charge for the operation of the Creator Hub; the introduction of Nekowemon IP and the Creator Program; the introduction of Creators or Creative Content; publicity; promotion; and other related purposes.
2. The use described in the preceding paragraph includes publication on websites, social media, video-sharing platforms, the Creator Hub, and other online media operated or used by Nekowemon Official, as well as use in videos, advertisements, events, exhibitions, introductory materials, and other media.
3. Nekowemon Official may make adjustments to Creative Content to the extent necessary for the uses described in Paragraph 1, including resizing, cropping, adding text, translation, editing, format conversion, and other necessary adjustments.
4. The use described in Paragraph 1 includes use for the introduction and promotion of Fan Creative Content, Community Awards, and other creative activities, events, or recognition programs within the Creator Hub.
5. Even if Nekowemon Official earns advertising revenue or other revenue from a website, social media account, video, or other medium on which Creative Content is used for the purposes described in Paragraph 1, that fact alone does not entitle the Creator to compensation, royalties, revenue sharing, or any other payment.
6. Use under this Article does not transfer copyright in the Creative Content to Nekowemon Official.
7. Merchandising of the Creative Content itself, adoption of the Creative Content for corporate projects, and other business uses beyond the purposes described in Paragraph 1 are governed by Articles 19 and 25 and other applicable provisions of these Terms of Use.
8. Use under this Article may continue, pursuant to the permission granted under Article 7, even if the Creator withdraws from the Creator Hub, is automatically withdrawn, or becomes unreachable.
Article 15 (Fan Creative Content: Fan Works and Fan Lore)
1. Nekowemon Official may recognize as Fan Creative Content Creative Content that has influenced creative activities within the Creator Hub and has contributed to the development of new Creative Content or Derivative Creation, based on recommendations from Nekowemon Staff or through other methods.
2. Recognition as Fan Creative Content is granted to the Creative Content itself and does not constitute the granting of any qualification or title to the Creator.
3. Recognition as Fan Creative Content does not indicate the relative superiority of Creative Content, official status, or a single correct world, setting, or story within the Nekowemon Universe.
4. Nekowemon Official may feature the relationships between Fan Creative Content and Derivative Creative Content based on it within the Creator Hub or through other media operated or used by Nekowemon Official.
5. The methods of recognition, display, and other details relating to Fan Creative Content are subject to the Creator Hub User Guide and other methods specified by Nekowemon Official.
Article 16 (Community Awards)
1. The Creator Hub community may hold Community Awards as events to feature creative activities and Works by Creators.
2. Creators may enter Works that they have created themselves and made publicly available through external services or other media, in accordance with the conditions established for each Community Award.
3. In a Community Award, multiple or a specified number of Works may be selected from each category through voting by Creators participating in the Creator Hub.
4. As a general rule, Creators who were directly involved in the creation of a Work selected in a Community Award will be granted Community Certified Creator recognition indicating the applicable year.
5. Community Certified Creator recognition does not indicate a ranking among Creators or any permanent superiority of one Creator over another.
6. The categories, entry requirements, eligibility period, voting method, number of Works to be selected, and other conditions for each Community Award will be determined by the rules established for that Community Award or by other methods established by the community.
7. Nekowemon Official may feature Works and Creators selected in Community Awards on its website, social media, or other media operated or used by Nekowemon Official.
Article 17 (Canon Creative Content: Canon Works and Canon Lore)
1. Nekowemon Official may recognize Creative Content as Canon Creative Content after completing the necessary rights clearance.
2. When Creative Content is recognized as Canon Creative Content, the copyright in that Creative Content, including the rights provided for in Articles 27 and 28 of the Copyright Act of Japan, will be transferred to Nekowemon Official. The transfer of copyright and other specific conditions will be set out in a separate agreement.
3. A Creator who created the original Creative Content on which Canon Creative Content is based will continue to be treated as the original creator of that Creative Content after Canon recognition. Credits and other forms of attribution will be determined in a separate agreement.
4. The original Creator of Canon Creative Content and other Creators participating in the Creator Hub may engage in Derivative Creation based on that Canon Creative Content in accordance with these Terms of Use. However, Derivative Creation may be restricted by a separate agreement or other conditions separately established by Nekowemon Official.
5. Derivative Creative Content created based on Canon Creative Content does not automatically become Canon Creative Content. It becomes new Canon Creative Content only if Nekowemon Official completes the necessary rights clearance and recognizes it as Canon.
6. Copyright in expressions newly created by a Creator through the Derivative Creation described in the preceding paragraph belongs to that Creator in accordance with Article 10, unless the Derivative Creative Content is recognized as new Canon Creative Content.
7. Multiple pieces of Canon Creative Content may coexist as Works or stories with different worlds or settings.
8. Recognition as Canon does not indicate the quality or popularity of Creative Content or any ranking among Creators.
9. Advertisements, promotional materials, product designs, and other materials created or used in corporate projects do not constitute Canon Creative Content unless Nekowemon Official recognizes them as Canon.
Article 18 (Canon Creators)
1. Nekowemon Official may recognize a Creator who has played a substantial role in the planning or creation of Canon Creative Content as a Canon Creator.
2. Recognition as a Canon Creator is based on whether the Creator played a substantial role in the planning or creation of the Canon Creative Content, regardless of the circumstances under which that Creative Content was created.
3. A Creator commissioned to produce content in accordance with plans, specifications, instructions, or similar materials prepared by Nekowemon Official or another party will not be recognized as a Canon Creator if the Creator was responsible only for producing the content in accordance with those materials.
4. Recognition as a Canon Creator indicates that the Creator has a record of substantial involvement in the planning or creation of Canon Creative Content. It does not guarantee that Nekowemon Official will continue to commission the Creator to create future Creative Content or other materials. Recognition as a Canon Creator also does not require the Creator to create future Creative Content or other materials for Nekowemon Official or any company without compensation.
5. A Canon Creator may engage in Derivative Creation based on Canon Creative Content that the Creator was involved in planning or creating, in accordance with these Terms of Use. However, Canon Creators do not have the exclusive right to engage in Derivative Creation based on such Canon Creative Content. Other Creators participating in the Creator Hub may also engage in Derivative Creation in accordance with Article 17, Paragraph 4.
6. Creative Content newly created by a Canon Creator does not automatically become Canon Creative Content. If such Creative Content is to be treated as Canon Creative Content, the necessary rights clearance provided for in Article 17 must be completed.
7. Recognition as a Canon Creator is separate from Official Certified Creator recognition and other forms of recognition. Recognition as a Canon Creator alone does not result in the granting of any other recognition.
Article 19 (Adoption for Merchandising, Corporate Projects, and Other Uses)
1. Nekowemon Official may select Creative Content introduced and shared in the Creator Hub as a candidate for merchandising, games, animations, comics, publishing, events, other businesses relating to Nekowemon, or corporate projects.
2. If Nekowemon Official newly adopts Creative Content for a purpose described in the preceding paragraph while the Creator is participating in the Creator Hub and can be contacted by Nekowemon Official, Nekowemon Official will enter into a separate agreement with the Creator setting out the method and period of use, rights clearance, compensation, and other necessary conditions.
3. Depending on the Creative Content being adopted and the nature of the project, the agreement described in the preceding paragraph may establish provisions concerning the handling of copyright; use by Nekowemon Official, companies, or other third parties; modification; adaptation; sublicensing; credits; compensation; royalties; and other necessary matters.
4. If the Creative Content being adopted is to be recognized as Canon Creative Content, the necessary rights clearance will be completed in accordance with Article 17.
5. The selection of Creative Content as a candidate for merchandising, a corporate project, or another business activity, or the fact that Creative Content has previously been adopted, does not guarantee the Creator any future adoption, ongoing commissions, compensation, or other opportunities.
6. Creators may not, with respect to Creative Content introduced and shared in the Creator Hub, enter into agreements with companies or other business entities for merchandising, advertising, promotion, or other commercial use, or directly authorize such use, without involving Nekowemon Official.
7. If a Creator has withdrawn from the Creator Hub, has been automatically withdrawn, or is unreachable, the use of Creative Content for merchandising, corporate projects, or other business activities will be governed by Article 25.
Article 20 (Creator License — Limited Project)
1. If Nekowemon Official determines that it is necessary for a Creator participating in the Creator Hub to participate in a specific corporate project conducted by Nekowemon Official or a third party, Nekowemon Official may grant that Creator a Creator License (Limited Project).
2. A Creator License (Limited Project) applies only to the specified corporate project and for the specified period.
3. The standard license fee for a Creator License is not required for a Creator License (Limited Project).
4. A Creator who is granted a Creator License (Limited Project) will be granted Commercial Creator status during the applicable period to the extent necessary for the relevant project.
5. A Creator License (Limited Project) does not grant the Creator the general usage rights available under the Creator License (Basic Plan) or Creator License (Pro Plan).
6. When a Creator License (Limited Project) ends, the Commercial Creator status granted for the relevant project will also end.
7. If the Creator separately has a Creator License (Basic Plan) or Creator License (Pro Plan), the granting or termination of a Creator License (Limited Project) will not affect the Creator’s agreement under the Basic Plan or Pro Plan.
Article 21 (Creator Characters)
1. Commercial Creators participating in the Creator Hub may register characters they have created as Creator Characters in accordance with conditions separately established by Nekowemon Official.
2. Registration of a Creator Character requires confirmation or review by Nekowemon Official and completion of other prescribed procedures.
3. Copyright in a character formally registered as a Creator Character will be transferred to Nekowemon Official free of charge.
4. Even after registration of a Creator Character, the name of the Creator who created the character or other credits may be displayed.
5. Creator Characters may be used by Nekowemon Official and other Creators within the Creator Hub for Creative Content, Derivative Creation, and other creative activities.
6. Even if the Creator who created a Creator Character ceases to hold Commercial Creator status, any Creator Character that has already been formally registered may continue to be used within the Creator Hub.
7. Details concerning the creation, registration, use, credits, number of characters that may be registered, and other matters relating to Creator Characters are subject to the Creator Hub User Guide and other conditions established by Nekowemon Official.
Article 22 (Official Certified Creators)
1. Nekowemon Official may recognize a Creator whose technical skills in a particular creative field have been demonstrated through Works or other creative activities as an Official Certified Creator in that field.
2. Works submitted to Community Awards and other creative activities within the Creator Hub may serve as opportunities for, or as one of the factors considered in, recognition as an Official Certified Creator.
3. Nekowemon Official may recognize a Creator as an Official Certified Creator after reviewing the Creator’s Works, production record, and other creative activities, regardless of whether those activities took place within the Creator Hub.
4. A Creator may be recognized as an Official Certified Creator in multiple creative fields.
5. Official Certified Creator recognition is separate from Community Certified Creator recognition. Recognition as a Community Certified Creator is not a requirement for recognition as an Official Certified Creator.
6. Official Certified Creator recognition is separate from recognition as a Canon Creator. Recognition as an Official Certified Creator alone does not make the Creator a Canon Creator or make Creative Content created by that Creator Canon Creative Content.
7. The creative fields, recognition methods, display, and other details relating to Official Certified Creators are subject to the Creator Hub User Guide and other methods specified by Nekowemon Official.
Article 23 (Withdrawal and Automatic Withdrawal)
1. Creators may withdraw from the Creator Hub in accordance with the procedures specified by Nekowemon Official.
2. Nekowemon Official may automatically withdraw a Creator from the Creator Hub if the Creator has not used the Creator Hub for a certain period of time or meets other conditions established by Nekowemon Official.
3. A Creator who withdraws or is automatically withdrawn from the Creator Hub may no longer introduce or share new Creative Content, engage in Derivative Creation, or conduct other activities as a participant in the Creator Hub.
4. Withdrawal or automatic withdrawal from the Creator Hub does not transfer to Nekowemon Official the copyright in Creative Content previously introduced and shared by the Creator in the Creator Hub. However, this does not apply to Canon Creative Content, Creator Characters, or other content for which copyright has been transferred to Nekowemon Official under a separate agreement or these Terms of Use.
5. Uses of Creative Content introduced and shared in the Creator Hub before withdrawal or automatic withdrawal that were already permitted to Nekowemon Official and other Creators under Article 7 will continue after withdrawal or automatic withdrawal.
6. Other Creators may continue to engage in Derivative Creation based on the Creative Content described in the preceding paragraph after the Creator’s withdrawal or automatic withdrawal, in accordance with these Terms of Use. Nekowemon Official may also continue to use such Creative Content within the scope provided for in Article 7 and may permit companies and other third parties to use it to the extent necessary.
7. A Creator may not, solely on the grounds of withdrawal or automatic withdrawal, request the discontinuation of uses permitted under these Terms of Use before the withdrawal or automatic withdrawal, the discontinuation of use of Derivative Creative Content already created, or the cessation of other creative activities within the Creator Hub. However, this does not apply where otherwise provided by applicable law or these Terms of Use.
Article 24 (Unreachable Creators)
1. If Nekowemon Official attempts to contact a Creator using the Creator’s registered email address, Discord, or other registered contact method but receives no response for a certain period of time and is unable to contact the Creator, Nekowemon Official may treat the Creator as unreachable.
2. Even if a Creator becomes unreachable, uses of Creative Content introduced and shared by that Creator in the Creator Hub that were already permitted under Article 7 will continue.
3. Other Creators may continue to engage in Derivative Creation based on Creative Content created by an unreachable Creator in accordance with these Terms of Use. No new permission from the unreachable Creator is required in order to engage in such Derivative Creation.
4. Even if a Creator becomes unreachable, Nekowemon Official may continue to use that Creator’s Creative Content within the scope provided for in Article 7 and may permit companies and other third parties to use it to the extent necessary.
5. If contact with the Creator is restored, subsequent handling will be governed by the Creator’s participation status in the Creator Hub at that time, these Terms of Use, and any separate agreements.
Article 25 (Business Use of Creative Content of Creators Who Have Withdrawn, Been Automatically Withdrawn, or Become Unreachable)
1. If a Creator has withdrawn from the Creator Hub, has been automatically withdrawn, or is unreachable, Nekowemon Official may exercise the usage rights already granted under Article 7 and use Creative Content introduced and shared by that Creator in the Creator Hub for merchandising, games, animations, comics, publishing, events, other businesses relating to Nekowemon, or corporate projects.
2. Nekowemon Official may permit companies, production companies, manufacturers, distributors, distribution service providers, and other third parties to use such Creative Content to the extent necessary for the uses described in the preceding paragraph.
3. If Creative Content is used under Paragraphs 1 and 2 during a period in which the Creator has withdrawn, has been automatically withdrawn, or is unreachable, no compensation, royalties, revenue sharing, or other payment will arise for use during that period.
4. If the business activity or corporate project described in Paragraph 1 is ongoing when a Creator who withdrew or was automatically withdrawn rejoins the Creator Hub, or when contact with an unreachable Creator is restored, Nekowemon Official may establish with the Creator the necessary rights clearance, compensation, and other conditions applicable to subsequent use.
5. After the rights clearance described in the preceding paragraph has been completed, compensation, royalties, or other payment may arise for subsequent use in accordance with the conditions agreed between Nekowemon Official and the Creator. Rejoining the Creator Hub or restoration of contact alone does not automatically give rise to any payment.
6. The Creator may not retroactively claim compensation, royalties, revenue sharing, or other payment for any use occurring before completion of the rights clearance described in Paragraph 4.
7. If, through the rights clearance described in Paragraph 4, the Creative Content is to be recognized as Canon Creative Content, the necessary rights clearance will be completed in accordance with Article 17 to transfer to Nekowemon Official the copyright in that Creative Content, including the rights provided for in Articles 27 and 28 of the Copyright Act of Japan.
8. If, after the Creator rejoins the Creator Hub or contact is restored, the Creative Content is newly adopted for merchandising, a corporate project, or another business activity, Article 19 will apply.
Article 26 (Rejoining the Creator Hub)
1. A Creator who has withdrawn or been automatically withdrawn from the Creator Hub may apply to rejoin the Creator Hub in accordance with the procedures specified by Nekowemon Official.
2. Nekowemon Official may approve the Creator’s application to rejoin after conducting any necessary review.
3. Rejoining the Creator Hub does not retroactively give rise to any compensation or other rights with respect to any use of Creative Content that occurred while the Creator had withdrawn, had been automatically withdrawn, or was unreachable.

Article 28 (Response to Violations)
1. If a Creator violates these Terms of Use, community rules, or other related terms or rules, Nekowemon Official may, as necessary, issue a warning, modify or delete posts, restrict use, suspend participation in the Creator Hub, or take other necessary measures.
2. In the event of a serious violation, repeated violations, or other circumstances where Nekowemon Official determines that such action is necessary for the operation of the Creator Hub, Nekowemon Official may remove the Creator from the Creator Hub or refuse to permit the Creator to rejoin.
3. Even if a Creator is removed from the Creator Hub or their eligibility to participate is revoked under this Article, the rights to use Creative Content granted by that Creator under these Terms of Use while participating in the Creator Hub will not terminate.

3. Nekowemon Official may terminate the operation of the Creator Hub when necessary.
4. Even if operation of the Creator Hub is terminated, rights already granted or transferred under these Terms of Use will not terminate unless otherwise provided in these Terms of Use or a separate agreement. Further details will be separately determined by Nekowemon Official at the time of termination.
Article 30 (Registration Information and Communications)

2. For Creators who have entered into a Creator License agreement, the Creator License Terms and Conditions and other conditions relating to the Creator License will apply in addition to those specified in the preceding paragraph.
3. If a separate agreement or conditions are established for a corporate project, Canon Creative Content, or other matters, and such separate agreement or conditions differ from these Terms of Use, the separate agreement or conditions will prevail.
Article 32 (Changes to These Terms of Use)
1. Nekowemon Official may amend these Terms of Use as necessary due to changes in the content or operation of the Creator Hub, the status of creative activities, changes in applicable law, or other circumstances.
2. If these Terms of Use are amended, Nekowemon Official will provide notice of the changes and the effective date through the Creator Hub, the official website, or other appropriate means.
3. If a Creator uses the Creator Hub after the amended Terms of Use take effect, the Creator will be deemed to have agreed to the amended Terms of Use.
